The San Diego Superior Court has certified a class in a lawsuit called Harold K. Ticho v. Budget Rent A Car System, Inc. In this lawsuit, Plaintiff contends that Budget unfairly and without notice charged renters more money for returning a vehicle early and that this practice, coupled with the failure to disclose the higher rental rates, violates California law. Budget contends, among other things, that renters who obtain Budgets agreement to provide a discounted rate for a specified rental period e.g., a discounted rate for a four day rental and breach that agreement by returning the car before the time and or date set forth on the rental agreement are not entitled to any discount and understand that they are not and would not be entitled to any discounted rate.
Plaintiff, on behalf of the Class, and Budget have concluded it is in their best interests to settle the Action. The parties have therefore negotiated a proposed settlement and the Court has granted preliminary approval of that settlement, subject to a final approval hearing that is set for November 3, 2006
This case affects you if You rented a vehicle at a California Budget location between November 22, 2002 and the present except employees of Budget or Cendant Corporation or their affiliates and returned the vehicle before the DUE IN time stated on the Rental Document and as a result were charged rates higher than those specified on the Rental Document.
You are a California resident who rented a vehicle from Budget at any of its United States locations between November 22, 2002 and the present except employees of Budget or Cendant Corporation or their affiliates and returned the vehicle before the DUE IN time stated on the Rental Document and as a result were charged rates higher than those specified on the Rental Document.
Each and every member of the Class who complies with the Court ordered claims process will have the choice of either a cash refund for the exact dollar amount of the difference between the contract rental amount the rate for the minimum rental period set forth in the rental agreement signed by the renter and the amount actually charged that customer plus any additional taxes that the class member was required to pay because of that difference OR one of the following coupons
Rs 675.00 off a weekly rental large vans and trucks excluded. Free day on a weekly rental 5th day free on any car but large vans and trucks excluded. Rs 450.00 off a weekend rental large vans and trucks excluded.Third weekend free but large vans and trucks excluded.
Rs 2250.00 off a long term rental and minimum rental period must be 30 daysDouble upgrade on any car classification but large vans and trucks excluded.
